This policy sets out the rules for using the Artham Fintech Consulting Private Limited website, including what you may and may not do, how accounts and submissions are handled, and what happens if the rules are breached.

In short. Use the site for legitimate business purposes. Do not scrape it, attack it, upload unlawful material or misrepresent who you are. We can suspend access if you do, and we are required by Indian law to remove unlawful content when properly notified.

1. Scope and acceptance

1.1 Application

This Website Usage Policy governs access to and use of arthamfintech.com, including the store, forms, downloadable material, client portals linked from the site, and any communication channel we make available through it. It applies to every visitor, whether or not you buy anything.

1.2 Relationship to other documents

This policy sits alongside our Terms and Conditions, Privacy Policy, Cookie Policy and Disclaimer. Where the subject matter overlaps, the Terms and Conditions govern the commercial relationship and this policy governs conduct on the website.

1.3 Acceptance and changes

Using the site signifies acceptance of this policy. We may amend it at any time, and the version published at the time of your visit applies. Material changes are announced on the site.

1.4 Eligibility

The site is intended for persons aged eighteen years or above who are competent to contract under the Indian Contract Act, 1872, and for organisations acting through an authorised representative. It is not directed at children.

2. Permitted use

You may browse the site, read and print pages for internal business reference, download material we make available for download, submit enquiries, and purchase services in accordance with our Terms and Conditions. Any other use requires our prior written consent.

3. Prohibited conduct

3.1 Unlawful and harmful use

You must not use the site for any purpose that is unlawful, or in a manner that infringes the rights of, restricts or inhibits the use of the site by any other person. Without limitation, you must not host, display, upload, publish, transmit or share information that:

  • belongs to another person and to which you do not have a right;
  • is obscene, paedophilic, invasive of another’s privacy including bodily privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, or otherwise inconsistent with or contrary to the laws in force;
  • is harmful to a child;
  • infringes any patent, trademark, copyright or other proprietary right;
  • deceives or misleads the addressee about the origin of the message, or knowingly communicates information which is patently false or misleading in nature;
  • impersonates another person;
  • threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of a cognisable offence, or prevents investigation of an offence, or insults a foreign state;
  • contains a software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
  • violates any law for the time being in force.

This list reflects the categories set out in the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

3.2 Technical restrictions

  • No automated scraping, crawling, harvesting or systematic extraction of content, except by search-engine crawlers obeying our robots directives.
  • No attempt to gain unauthorised access to any part of the site, its servers, databases or any connected system, and no penetration testing, vulnerability scanning or denial-of-service activity without our prior written authorisation.
  • No circumvention of authentication, rate limiting, paywalls or security features.
  • No reverse engineering, decompilation or derivation of source code from anything provided through the site.
  • No framing, mirroring or deep linking that misrepresents the origin of our content.
  • No use of our content to train or fine-tune a machine-learning model without our prior written consent.

3.3 Commercial restrictions

You must not resell, sublicense or make our content or deliverables available to third parties, use the site to advertise or solicit, submit fraudulent orders or payment instruments, or use our brand, name or marks in a way likely to cause confusion.

4. Accounts, credentials and portals

4.1 Accuracy

Where you create an account or are issued portal credentials, you must provide accurate information and keep it current.

4.2 Security

You are responsible for maintaining the confidentiality of credentials issued to you and for all activity under them. Credentials are personal to the named individual and must not be shared. Notify us immediately at info@arthamfintech.com if you suspect unauthorised use.

4.3 Suspension

We may suspend or disable credentials where we reasonably believe they have been compromised, where the associated engagement has ended, or where this policy has been breached.

5. User submissions

5.1 Your responsibility

You are responsible for anything you submit through forms, uploads, reviews or correspondence, and you warrant that you have the right to submit it and that it does not breach section 3.1.

5.2 Licence to us

By submitting material that is not confidential client information — for example feedback on the website — you grant us a non-exclusive, royalty-free licence to use it for the purpose of operating and improving our services. Confidential client information supplied under an engagement is governed by the confidentiality provisions of our Terms and Conditions, not by this section.

5.3 Reviews and testimonials

Where we publish a client testimonial or review, it is published with the individual’s consent and reflects that individual’s own experience. We do not publish, solicit or incentivise fabricated reviews, which would breach the Consumer Protection Act, 2019 and the guidelines on dark patterns issued by the Central Consumer Protection Authority.

6. Intellectual property

All text, graphics, layout, structure, methodologies, frameworks and downloadable material on the site are owned by or licensed to Artham Fintech Consulting Private Limited and are protected by the Copyright Act, 1957, the Trade Marks Act, 1999 and equivalent international law. No right or licence is granted except as stated in section 2. Our name, logo and marks may not be used without written permission. Notices of alleged infringement should be sent to the Grievance Officer with sufficient detail to identify the material, the right asserted and the basis of the claim.

7. Availability and changes to the site

We aim to keep the site available but do not guarantee uninterrupted access. We may modify, suspend or withdraw any part of the site, including a service listing, without notice. Where a suspension affects a paid engagement in progress, we will contact you and continue delivery through alternative channels.

8. Links to and from the site

Links to third-party sites are provided for convenience and do not imply endorsement; we do not control and are not responsible for their content or practices. You may link to our home page in a fair and lawful way that does not damage our reputation or suggest an association that does not exist. You must not frame our pages or link from a site you do not own.

9. Enforcement and content removal

9.1 Our rights on breach

Where we reasonably believe this policy has been breached we may issue a warning, remove or disable access to material, suspend or terminate access to the site and any account, cancel an order, and take legal action to recover losses. We may disclose relevant information to law-enforcement authorities where we are required or permitted to do so.

9.2 Complaints about content

Complaints about content published on the site, including allegedly infringing or unlawful material, should be sent to the Grievance Officer. We acknowledge complaints within 24 hours and dispose of them within 15 days, in accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. Complaints regarding content that exposes an individual’s private area, shows nudity or a sexual act, or is in the nature of impersonation including morphed images, are actioned within 24 hours of receipt of a valid complaint.

9.3 Lawful orders

We remove or disable access to information on receipt of a valid order from a court of competent jurisdiction or a notification from an appropriate government agency under section 79(3)(b) of the Information Technology Act, 2000.

10. Disclaimer and liability

Website content is general information only, as explained in our Disclaimer, and is not professional advice. To the extent permitted by law, we are not liable for loss arising from use of, or inability to use, the site, or from reliance on its content. Nothing excludes liability that cannot lawfully be excluded, including under the Consumer Protection Act, 2019.

11. Governing law and jurisdiction

This policy is governed by the laws of India. Disputes are subject to the dispute-resolution provisions of our Terms and Conditions, including arbitration seated in New Delhi under the Arbitration and Conciliation Act, 1996, and, subject to that, to the exclusive jurisdiction of the courts at New Delhi.
